Case Summary
The client had existing Oracle ULA which was due for expiry & contained restrictions on certification on public cloud and virtual environments creating a major compliance exposure for the client. Oracle sales teams approached the client to force 3 Yr ULA renewal at twice the value of the existing contract & also sent a formal Audit notice. The client wanted to have the best way out with the minimal cost impact to exit from this situation & engaged Rizen for help.
What we did?
The client did not have in house SAM team so we analyzed their license deployments using our tools & conducted a detailed contracts review & identified the exposure with license certification & compliance gaps. Since ULA was still in force we created a quick strategy to optimize the license deployments on available infrastructure to compensate for the license shortfall at certification. We analyzed deployments on AWS & created a counter strategy to defend Oracle’s claim by migrating loads to dedicated hosts. We also created a detailed legal strategy to defend Oracle’s audit teams and lead the negotiations with Oracle without giving in to Oracle’s pressure. We reviewed and analyzed all the usage of Database & options programs & helped to reconfigure the settings to avoid unintended use of Options. In the end, we negotiated with Oracle the go-forward contract for the minimum term of 1 Yr ULA without restrictions on certification on cloud & VMs securing the customer a time to cure their non-compliance at a significantly lower value.
Result
Oracle agreed to provide a 1 year term ULA instead of std 3 years & removed restrictions on certifying licenses in a virtual environment & public cloud allowing the customer to indirectly regularize its compliance. We were able to reduce the price by 40% compared to Oracle's best offer to the client before our involvement. The client has designed plans to reorganize hardware and infra to be compliant before ULA expires.
